Kansas Court Says Poker Game Illegal Gambling
WICHITA, KANSAS --
A new card game called Kandu Challenge has been ruled an illegal gambling game by a Kansas judge who says the game is predominantly chance. Sedgwick County District Judge Timothy Lahey ruled that the variation on poker does not meet the requirement to be mostly skill in order to be legal.
Highlands Cardroom in Wichita was ordered to stop playing the game, which state attorneys see as a Texas Hold'em game with a couple twists thrown in to fit the game through legal loopholes. The owners of the gaming hall and the inventors of the game sued, only to be denied by the judge.
The basic difference between Hold'em and Kandu is that, right before dealing, the dealer flips the back upside down and shows the players the cards for a couple of seconds. Creator Shane McCollough says the new rule makes the game one of memory and skill.
The judge said in his decision that all three elements of illegal gambling occur within the framework of Kandu Challenge. These include consideration offered for a prize, to be awarded by chance or luck.
“We are pleased the court agreed with our view that this game was just another creative form of illegal gambling,” said state Attorney General Steve Six.
