Poker Court Cases Finding Game Skill, Not Gambling
GREELEY, COLORADO --
A series of trials around the US are resulting in strong legal precedents being set establishing poker as a legal game that does not fit the definition of illegal gambling. A Colorado court ruled that players at a local bar were not guilty of crimes violating gambling statutes as poker did not qualify as gambling.
The organizers and dealers at a game held at Rafferty's Bar in Greeley, Colorado, were arrested and charges with commiting professional gambling after police raided the saloon. Undercover officers had played at the game in previous weeks to establish exactly what was happening.
But a jury found defense arguments that poker should be considered a game of skill compelling. Testimony by statistics experts and evidence provided with the assistance of the Poker Players Alliance led the jury to conclude that laws against games of chance had no jurisdiction over poker.
The result follows a similar finding a few weeks ago in Pennsylvania, in which a judge determined poker is a game in which skill is the dominant factor, even though luck is involved. The cases help to establish a system of precedents for courts around the country, as South Carolina is next to try to define poker's legality.
