Gaming Analyst Sees Intrastate Online Gambling as First Step

Nelson Rose says intrastate online gambling has fewer barriers and is likely to beat federal regulation to implementation. The professor of law at Whittier College points to the ongoing recession as problematic for Barney Frank's online casino bill, and says Internet gambling will be handled state by state, at least initially.

According to Rose's analysis of California's online poker bill, existing state regulatory frameworks will give states an edge in creating rules for Internet gaming. Potential repeal of the UIGEA will not affect state legal changes, as the prohibitory bill grants states specific exemptions for intrastate gaming.

"More than 20 states already have at-home betting on horse racing, so there is no logical reason to not have the same for dog racing, or poker. The California bills authorizing Internet poker have actually already been introduced, though the specific language will be added by amendment in late May or early June," says Rose.

As far as which gambling operators will flourish under the changing online gaming laws, Rose thinks the first to position itself will reap great rewards. He cites PartyPoker as an operator that took full advantage of being in the market early, only losing its popularity after ceding to the UIGEA.

"California is such an enormous market, that the gaming companies that are most successful if the state legalizes intrastate poker will dominate the U.S. and even the world markets when Congress allows interstate compacts," Rose advises.

The professor notes Harrah's has the World Series of Poker brand and an existing connection with California tribal casinos, although online casinos such as 888.com hope to follow PartyGaming's lead to "a clean bill of health and the right to start taking legal bets from Americans, as soon as the law is made clear."
