Suit to Recover Gambling Losses Boomerangs
DETROIT, MICHIGAN --
An attorney who sued MotorCity Casino in Detroit to get his client's gambling losses returned is now facing trouble for filing a frivolous lawsuit. Frank Cusumano, Jr., has been ordered by Wayne Circuit Judge Michael Sapala to appear at an evidentiary hearing to determine if his attempt to reclaim money lost gambling at the casino represents a waste of the court's time.
Italo Parise had hired Cusumano to try to recover $673,854 he lost at the Detroit casino. Cusumano brought forth the suit, only to be told the law he cited to justify the filing only applies to illegal gambling.
Attorneys for the casino, anxious to avoid having to defend against such absurd suits, asked the judge to pursue charges against Cusumano. If the court rules the lawsuit is frivolous, Cusumano may face having to pay the casino's attorney fees, about $13,000.
"The judge said he does not easily order sanctions but he was very troubled by the nature of the lawsuit," said Deborah Brower, the casino's lawyer.
Parise claimed he lost the money over the course of gambling at MotorCity Casino for a decade. Other remorseful losers have tried to recover gaming losses by claiming casinos tricked or enticed them, without much result.
