Kentucky Appeal Set for Online Casino Domain Name Case
LEXINGTON, KENTUCKY --
The Kentucky State Supreme Court announced it will hear oral presentations in the appeal by the state of its defeat in its attempt to seize the domain names of 141 online casinos. The court will hear the case against online gambling operators on October 22nd.
The Interactive Media Entertainment and Gaming Association had filed suit against the forfeiture order awarded by a Kentucky judge allowing the state to claim the domain names of the listed Internet casinos. An appeals court found that the application of a Kentucky law against gambling devices did not include the Internet, preventing the seizure.
Governor Steve Beshear has pursued this white whale of a case all the way to the state Supreme Court, hoping against hope that some twisted logic would appear supporting his claim of jurisdiction over sites operating far beyond Kentucky borders. The numerous civil groups, Internet freedom supporters, and other concerned parties joining iMEGA in protesting the seizure attempt left Beshear a lonely figure, left unsupported in the case even by his Attorney General.
“From the beginning, Kentucky law has clearly supported our position, and a win in the State Supreme Court will put the final emphasis on that,” said iMEGA chief Joe Brennan, Jr.
Only Beshear's ability to find attorneys so greedy they took the case on a contingency basis has kept the case from using up massive state revenues at a time when the state is struggling severely, although costs have still mounted to maintain the campaign.
